(Note:  They are not too anxious about getting it on the agenda as in oops I guess we don't have time before the LAFCO Hearing, but it showed we were sensitive to the Mesa, didn't it?)

Has Chad Mayes added the withdrawal of the Yucca Mesa Sphere of Influence to the August 4, 2009, Council agenda as he promised to do via the Hi-Desert Star, dated July 15, 2009, front page article?

If not, please explain.

Dear Ms. Karman,

I believe it is Council member Mayes’ intent to bring the issue under the Future Agenda Items, which is at the end of the meeting. The procedure for a Council member to place an item on the agenda is to request it at the Council meeting and must be supported by two other Council members to be placed on a future agenda. This is also in the Hi Desert Star article.

The way the Council rules read is that no one member of the council can place an item on the agenda, with the exception of the Mayor. 

Once the item is agreed upon at the Council meeting then the staff will determine what meeting it will appear.

I hope that answers your question. I have cut and paste the ordinance for your information.

ORDINANCE NO. 188

AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF YUCCA VALLEY, CALIFORNIA, AMENDING SECTION 180(A) OF CHAPTER 2.05. OF TITLE 2 OF THE TOWN OF YUCCA VALLEY MUNICIPAL CODE RELATING TO COUNCIL AGENDA

The Town Council of the Town of Yucca Valley does ordain as follows:

SECTION 1. MUNICIPAL CODE AMENDED:

1.1 Section 2.05.180 (A) of Title 2 of the Town of Yucca Valley Municipal Code is hereby amended to read as follows:

A. The Town Clerk or his/her designee shall prepare an agenda for each Council meeting. Items of business may be placed on the agenda at the direction of the Mayor, the Town Manager or three affirmative votes of the Town Council during discussion of Future Agenda Items at a Town Council Meeting. 

SECTION 2. NOTICE OF ADOPTION:

2.1 Within fifteen (15) days after the adoption hereof, the Town Clerk shall certify to the adoption of this Ordinance and cause it to be published once in a newspaper of general circulation printed and published in the County and Circulated in the Town pursuant to Section 36933 of the Government Code.

SECTION 3. EFFECTIVE DATE:

This Ordinance shall become effective thirty (30) days after the date of its adoption. 

APPROVED AND ADOPTED by the Town Council and signed by the Mayor and attested by the Town Clerk this 28th day of February , 2008.

It was reviewed today at the DRC that since we will be taking the Yucca Valley community together, including the Yucca Valley Airport District, the hearing will be no sooner than January 2010. I did not have a conversation with Mr. Takata so I’m unsure where the reference to December 2009 came from.
